For all products offered by Gomibo, you have a withdrawal period of 31 days. This means you can return a product within 31 days without having to give a reason. Gomibo extends the statutory 14-day cooling-off period to 31 days! This makes Gomibo unique in the market. On this page you can read all the conditions for exchanges and cancellations.

Your privacy and the secure processing of your personal data are very important to us! Naturally, you want to order a mobile phone and/or accessories without worrying about your privacy or online security. That is why we would like to explain how we handle your personal data in compliance with the General Data Protection Regulation (GDPR). 

Who is responsible for your data?

Gomibo, part of MobielWerkt BV, is responsible for all personal data you provide to us. Here are our contact details:

What data do we store and why?

Gomibo collects personal data in various ways. The data we collect depends on what you do on our website: do you simply visit the website without placing an order, or do you order something from us? What you order also makes a difference. We are happy to explain exactly which data we use.

• Order information

  Of course, when you place an order with us, we need to know who you are so we can help you as effectively as possible. That is why we ask you to provide your gender, date of birth, initials and surname. We also need your address to deliver your order. We share your initials, surname, address details, order number, mobile phone number and tracking code with the parcel carrier.

  We send you updates about your order by email and sometimes by text message. To do this, we need your email address and mobile phone number. We also send you invoices and information about products you buy from us. After an order, we sometimes ask for your feedback, usually by email and occasionally by phone. Your feedback helps us keep improving!

• Payment

  Payment for your order is always processed in a secure payment environment. The payment is also linked to the order within this secure environment. If you pay by credit card, we send your details directly from our secure payment environment to the payment processors.

• Product information

  When you buy a product from us, we store its IMEI and EAN numbers. The IMEI number is a unique code linked to your specific product. The EAN number identifies the product type. This helps us ensure that you actually received what you ordered.

• Orders with additional services

  Have you placed an order with Gomibo that includes certain services, such as insurance? If so, we may need additional information from you, such as an IBAN or an authorised direct debit to collect the insurance premium from your bank account.

• Communication

  When you place an order with us, we like to keep you informed by post, email, mobile phone or text message. Sometimes we send you messages with tips and tricks, security updates, review requests, personalised vouchers, discount offers or other information relevant to your order or personal interests. As a customer, you automatically receive all Gomibo communications except our newsletter. You only receive our newsletter if you have explicitly consented to it. You can easily manage your communication preferences through your Gomibo account .

  We use the following communication preferences:
  
  Order updates (always enabled) You receive information about your order, customer account, store appointment, payment and invoices.
  
  Service messages You occasionally receive information about your previous orders, such as usage tips, updates, and notifications.
  
  Personalised discounts, offers, tips and inspiration You only receive information specifically related to your previous order and preferences, such as personalised discounts, promotional gifts and tailored offers.
  
  Review requests You receive an invitation to review products or share your experience with our service after placing an order or contacting Gomibo.
  
  Newsletter You regularly receive offers, tips, news and useful information about products and services.

• Newsletter

  We send our newsletter by email. Of course, you will only receive it if you have explicitly given us permission. No longer want to receive our newsletter? You can unsubscribe by clicking the “Unsubscribe” button at the bottom of the newsletter or by changing your preferences in your Gomibo account .

• Offline and online tracking

  For your safety and ours, we record and store camera footage in our stores. Online, things work differently. When you use the Gomibo app, we store usage data from your mobile phone, such as the number of minutes, text messages and MB used, so that we can give you the best mobile phone advice. We also use tracking pixels to offer you a personalised shopping experience tailored to your needs.

  When you visit our website, we store your IP address, click data and cookies. You can easily manage your cookie settings in your internet browser. You can manage the cookie settings for major web browsers using the following links:

  Strictly necessary cookies
  When you visit our website or app, we use only technically necessary cookies to make our website and app user-friendly, effective and secure. These cookies help ensure that our website and app function optimally and are easy to use.

  Google Analytics
  To analyse our website and apps, we use Google Analytics, a web analytics service provided by Google Ireland Limited. Among other things, we collect your IP address, the date and time of your visit to our website or app, your click path, browser information, device information, pages visited, partner links, location data and purchase activity. We use this information to continuously improve our website and app and provide the best possible user experience. Google Analytics uses cookies, your browser’s web storage and tracking pixels to collect this information. Google stores all collected data in the USA. Google relies on standard contractual clauses as appropriate safeguards for the protection of personal data.

  Google Ads conversion tracking
  For online advertising and measuring the conversion rate on our website and in our app, we use the Google Ads service from Google Ireland Limited. When you click on one of our advertisements in a web browser provided by Google, a conversion-tracking cookie is automatically stored in your internet browser. These cookies are stored only for a limited time and do not contain any personal data. By placing a cookie, Google and we can tell whether you clicked on an advertisement, allowing us to target you personally with ads on our website and in our app. We also use cookies with remarketing or similar targeting features from Google Ireland Limited. We use these cookies to analyse your behaviour on our website and your interest in certain products or services, so that we can display personalised advertising. No personal data is processed through this targeting feature. This data may be processed by Google in the United States.   Google plug-ins
  In some parts of our website and app, we use the Google Maps and YouTube plug-ins from Google Ireland Limited. For example, we use Google Maps to show the locations of our stores so you can easily find our shop on the high street. We use YouTube in an iframe on our website and in our apps to show informative product videos as well as tips and tricks. Google may set cookies for both services, and data may be transferred to the USA. You can find more information in the privacy policies of Google and YouTube.

• Payment services

  If you pay for your order using PayPal, PayPal’s privacy policy also applies to your order. You can find PayPal’s privacy policy here: PayPal privacy statement

• Customer service

  When you contact our customer service team, we want to help you as effectively as possible. To do so, we store the email correspondence you have with our customer service employees. Phone calls may also be recorded for training purposes. We will always inform you of this before the call. Sometimes we ask you to provide certain personal information by email or during a phone call. We ask these questions to verify that you are indeed the customer associated with the order in question. We also take notes about our conversations so that we know exactly what was discussed if you contact us again.

• Returns & Repairs

  Would you like to exchange or cancel something, or do you have a defective product? We are happy to help! Before returning your device, it is important to back up your data and restore the device to factory settings (also known as a reset). This is necessary so that we can accept the device and so that all data is erased, leaving none of your personal information on the device.

  You are responsible for resetting your device. If you do not do so, or if the reset does not work, the data will still be erased from your device as far as possible. You also agree that your data may be shared with third parties such as a repair company.

  Repairs are carried out by specialised repair centres. If your device, or part of it, is replaced with a new one, the repair company will carefully destroy or recycle the old device or component.

How do we handle the sharing and storage of your personal data?

• Sharing personal data

  Your privacy is very important to us. That is why we only share certain personal data with partners and third parties when it is genuinely necessary, for example to fulfil your order. We never sell your data to third parties.

  To manage this properly, we have entered into a data processing agreement with every partner with whom we share your personal data. This agreement clearly defines who is responsible for which data. We share personal data with various partners to ensure your order is delivered within 24 hours and to provide the best possible service:

  • The payment data processor;
  • The parcel delivery service;
  • The communications data processor (such as for phone calls, text messages and email);
  • (Online) marketing channels;
  • The administrative data processor;
  • Where applicable: the insurer and authorised representatives;
  • Where applicable: the repair company;
  • Where applicable: the device manufacturer;
  • Where applicable: the risk assessor;
  • Where applicable: the identity document data processor;
  • Where applicable: the provider of certain services you ordered from Gomibo.

  Most of these parties are based in the EU and are subject to the General Data Protection Regulation. In some cases, we also share certain data with partners based in the United States of America (USA) who previously actively participated in the EU–US Privacy Shield. We have entered into strict agreements with these parties regarding the processing of personal data. These agreements are set out in standard contractual clauses (SCCs).

• Storing personal data

  We do not keep your personal data longer than necessary. In some cases, we need your personal data to detect fraud or illegal activity. In such cases, we are legally required to share this personal information with the police, judicial authorities or public prosecutor’s office if we receive a request. We also have tax obligations towards the tax authorities. This means that we store your personal data for legitimate, legal and commercial reasons in order to deliver the products and services you ordered and provide you with a safe and reliable service.

• Profiling and automated decision-making

  When you place an order with us, we may use public data sources and databases to verify your identity and purchasing behaviour. Based on all this information, an automated decision may be made about your order or another additional service.

• Protecting your personal data

  We always provide the highest level of information security. Our website uses a secure connection (indicated by “https” in the address bar) and has an SSL certificate. We also use the best available security software to store your personal data as securely as possible. This takes place in ISO 27001-certified data centres on our own servers in the Netherlands.

  We check and monitor which employees have access to which personal data and keep records of who has viewed which information. This way, we always know what happens to your personal data. In addition, all Gomibo employees have a certificate of conduct (Verklaring Omtrent Gedrag, VOG), so we can be confident that everyone handles your personal data securely.

• Your rights regarding your data

  As a Gomibo customer, you can of course request access to, correction of, transfer of or deletion of your personal data from our records at any time. You can do this through our customer service or by contacting our Privacy Team at privacy@gomibo.com. We will ask you to verify your identity so that we do not disclose your data to others.

• Deleting your data

  Of course, you can ask us to delete your data if you wish. This means you will no longer be a Gomibo customer. Our privacy specialists will process your request within 15 working days.

  No longer want to receive our newsletter? You can simply unsubscribe at the bottom of the newsletter or unsubscribe through the communication settings in your Gomibo account .
